SUN GRO HORTICULTURE SALES POLICY
The order is taken subject to availability of material. Quantity is shipped in same quantity ordered unless specified otherwise. Only items shipped are extended on the invoice at the price in effect at the time of shipment. Any sales, excise, or other special taxes assessed by federal, state, or other provincial authorities in effect at the time of shipment shall be for the purchaser’s account.
SUN GRO HORTICULTURE CLAIMS POLICY
LIMITED WARRANTY:
Sun Gro Horticulture Canada Ltd. expressly warrants that the composition of this product conforms to the description on the label. This warranty is given in lieu of any other warranty of any kind. See disclaimer of warranties below.
DISCLAIMER OF WARRANTIES:
THIS PRODUCT IS SOLD AS IS AND, EXCEPT FOR THE LIMITED WARRANTY REFERENCED ABOVE, EACH OF SUN GRO HORTICULTURE CANADA LTD., SUN GRO HORTICULTURE DISTRIBUTION INC., SUN GRO HORTICULTURE PROCESSING INC., AND ANY AND ALL OTHER AFFILIATIONS OF SUCH ENTERPRISES, SPECIFICALLY EXCLUDES ANY AND ALL WARRANTIES, WHETHER WRITTEN OR ORAL, OR IMPLIED, INCLUDING ANY WARRANTY OF PERFORMANCE, QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
LIMITATION OF REMEDIES:
In all cases, the liability of any and all of Sun Gro Horticulture Canada Ltd., Sun Gro Horticulture Distribution Inc., Sun Gro Horticulture Processing Inc. and any and all other affiliates for an alleged defective product shall be limited to replacement of the product or a refund of the purchase price, at Sun Gro Horticulture Canada Ltd.’s option. This is an exclusive remedy, and in no case shall Sun Gro Horticulture Canada Ltd. or any of its affiliates (including those referenced above) be liable for special, incidental or consequential damages.
If the purchaser declines to accept this Limited Warranty, Disclaimer of Warranties and/or Limitation of Remedies, then the purchaser shall return this package unopened to the seller and Sun Gro Horticulture Canada Ltd. will guarantee a refund of the purchase price.
PACKAGING PROHIBITION:
It is strictly prohibited to repackage this product for resale, with or without identification of the original manufacturer, without the advanced written permission of Sun Gro Horticulture Canada Ltd.
All claims must be reported within five (5) days from the receipt of material. Supporting documents must be submitted within thirty (30) days of receipt of material.
The documents required include Loading Chart and/or Delivery Receipt signed and dated: Inspection Report and/or pictures showing the car number and damaged merchandise. Seal numbers, where applicable, must also be recorded on one of the documents.
